ALJs are already forming their own opinions about the Supreme Court decision in Biestek’s application at Social Security hearings. The most common opinion being expressed is that because of Biestek vocational testimony is unassailable because it is "substantial evidence" even if it is rebutted or shown to be wrong. This is nonsense, and this webinar explains why. Make no mistake, Biestek was a loss for claimants, but it also presents important opportunities for effective representation of your clients.


As it turns out, Meredith and Karl have come to somewhat different, although not contradictory, conclusions about how to best respond to Biestek in terms of hearing preparation and presentation of vocational issues. It is our hope that sharing our perspectives will benefit NADR members to better prepare and present their claimants’ cases.
